General terms and conditions

Section 1 Scope of Application, Customer Information

The following terms and conditions govern the contractual relationship between Anton Baunach (sole proprietorship) and consumers and businesses who purchase goods via my website. By placing an order, the buyer expressly confirms that they have read and accepted the following terms and conditions of the seller. Any conflicting or deviating terms and conditions are not recognized by me. The contract language is German.

Section 2 Conclusion of Contract

1) The offers on my website www.ferrariteile.eu/ constitute a non-binding invitation to purchase goods.

2) You submit a non-binding inquiry for specific spare parts, tools, etc. I will check whether I have these goods in stock and make you a non-binding offer (subject to prior sale). Only your signed order, whether signed or submitted via email, constitutes a binding offer. I am entitled to accept this offer within two weeks by sending an order confirmation or the ordered goods. I expressly reserve the right to reject the order within the aforementioned period. Should an ordered item be unavailable because the seller is not supplied by their suppliers through no fault of their own, they are entitled to withdraw from the contract. In this case, the seller will inform the buyer immediately and, if applicable, offer delivery of a comparable item. If no comparable item is available or the buyer does not wish to receive a comparable item, any payments already made by the buyer will be refunded immediately. § 3 Prices

All prices quoted by the seller are binding and are gross prices in euros, including statutory VAT and any applicable packaging, shipping, and/or insurance costs. These costs are charged separately by the seller and are generally to be borne by the buyer. The seller will deliver the goods without charging statutory VAT if the conditions for an intra-Community supply are met. The buyer must provide proof of these conditions during the purchase process by stating their name and address, their trade or profession, and a valid VAT identification number (VAT ID number). In addition, the buyer (in the case of an intra-Community supply) must complete and return the original signed confirmation of receipt. Partial deliveries are permitted, provided they are reasonable for the buyer. Delivery is always at the buyer's risk and expense, unless the buyer is a consumer. The seller is entitled, but not obligated, to insure the goods at the buyer's request and expense.

Section 4 Customer Information: Storage of Your Order Data

The contract text is not stored by the seller and cannot be retrieved after an order has been placed. For deliveries of goods, the personal data I collect will be forwarded to the contracted shipping company as part of the contract processing. Section 5 Retention of Title

The purchased item remains my property until full payment has been received. In commercial transactions, ownership of the purchased goods only passes from the seller to the buyer once the buyer has settled all claims arising from the business relationship with the seller (extended retention of title). If the seller's retention of title to goods acquired in commercial transactions is extinguished by resale, combination, or processing of the purchased goods by the buyer, the buyer is entitled to the right to withdraw from the contract. If the buyer refuses to pay, the purchased goods are replaced by the new item or the claim arising from one of the aforementioned actions (extended retention of title).

§ 6 Liability

The seller is liable without limitation for damages caused intentionally or by gross negligence, for fraudulent concealment of defects, for the assumption of a guarantee of quality, for claims under the Product Liability Act, and for injury to life, body, or health.
